Messages like "no flights are available" or "no flights match your search criteria" will no longer be permitted on ticket agency Web sites when consumers search online for flights, even if no results are produced.
Such responses are considered misleading, according to the Department of Transportation, because they state or imply that no flights exist when they may be available on carriers the ticket agency does not represent or cover by its search engine.
The move is intended to prevent "potentially unfair or deceptive" language, Samuel Podberesky, assistant general counsel for Aviation Enforcement and Proceedings, wrote in a guidance notice recently posted on the department's Web site and sent directly to ticket agencies.
Online travel agencies and travel agents that use Internet flight-search tools to sell tickets are not required to include flights from all airlines in searches but in the future must display more precise language to reflect that results are only from airlines that it markets.
Alternative messages could include wording that is more clear, like: "no flights are available from the airlines we search," or "no nonstop flights are available from airlines covered by this Web site," to better inform the public, the notice advised. And using hyperlinks, agents could also list airlines specifically covered in their Web sites' searches.
The Office of Aviation Enforcement and Proceedings will give agencies until Nov. 19 to comply "before pursuing enforcement actions."
